Thank you for purchasing the Figuratti brand product, i.e. one of Figuratti cosmetic furniture (hereinafter referred to as “Product” or “Figuratti Furniture in singular and “Products” or “Figuratti Furniture” in plural). 

Figuratti sp. z o.o., with its registered office at 6 Suflerska St., 04-471 Warsaw, National Court Register KRS No.: 0000923100 (hereinafter referred to as the “Manufacturer“) grants the guarantee for the period of 12 months as of the date of purchase of the respective Figuratti Furniture (hereinafter referred to as the “Guarantee“) under the terms and conditions specified in this guarantee card (hereinafter referred to as the “Guarantee Card“).

Before using our Product, please read carefully the terms and conditions of this Guarantee and the Manufacturer’s key recommendations for the purchaser or user of the Product as part of this Guarantee Card.

The invoice issued by the Manufacturer (hereinafter referred to as the “Invoice“) serves as proof of purchase of the Product. The original Invoice signed by the Manufacturer or the Invoice in electronic version generated automatically upon the purchase of the Product together with the email in which the Invoice was sent should be kept for the entire Guarantee period – the Invoice  shall be the basis for the Manufacturer’s consideration of any guarantee claims.

The following terms and conditions of the Guarantee constitute the basis for the Manufacturer’s Guarantee for Figuratti Furniture. Please read them carefully and observe the Manufacturer’s recommendations.

I. General Terms And Conditions of Guarantee

Completeness and condition of the Product

Before using the Product, the completeness of the Product and the efficiency of its movement mechanisms must be carefully checked within 7 days of receipt of the Product. Please ensure that the Product has no visible damages. Any visible damage must be reported immediately to the Manufacturer. Failure to report such visible damage within 7 days of receipt of the Product shall result in no entitlement to make claims under the Guarantee. 

Guarantee Period 

The Guarantee is provided by the Manufacturer for a period of 12 months from the date of purchase of the relevant Product. The date of purchase is the date of the Invoice issued by the Manufacturer

Guarantee area 

The Guarantee applies to all purchasers of Figuratti Furniture.

Scope of Guarantee

In the event of manufacturing or mechanical defects of the Product resulting from the Manufacturer’s fault, the Manufacturer shall be obliged to repair or replace the Product in accordance with the provisions specified in this Guarantee Card.

The Guarantee specifically excludes:

  1. Any damage to or alteration of the Product resulting from the fault of the Purchaser or user of the Product or from the fault of persons or entities for the actions of which the Manufacturer is not responsible (e.g. from the fault of entities providing transport services, from the fault of entities repairing the Product to the extent not covered by the Guarantee, from the fault of entities or persons using the Product).
  2. Any damage to or alteration of the Product caused by improper use of the Product.
  3. Any alterations to the Product including their damage resulting from the use of the Products by their purchasers or users, such as:
    • wrinkling of the material resulting from the natural use of the Product;
    • dents in the foam during use;
    • wrinkling of materials that form a decorative element of the Product;
    • grease spots on the surface of the eco-leather;  
    • sounds and noises caused by joining and interaction of structural elements, which is a natural characteristic of the Product
    • mechanical damage and tearing of the material; 
    • changes in the elasticity of the cushions and softness of the blocks (seats, backrests, headrests); 
    • differences in the hardness of the Product’s elements resulting from different sizes and design solutions used.

The natural wear and tear characteristics of the Product, which are excluded from the scope of the Guarantee

The use of the Product results in natural wear and tear. The use of the Product naturally causes a number of changes that are not covered by the Guarantee.  

The Guarantee specifically excludes: 

Deformation of bent-glued seat frames

The Manufacturer allows permanent deformation of bend-glued seat frames, which occurs due to the functional elasticity of the seats to ensure comfortable use of the Product.

Discolouration of upholstery fabric

Dyed and/or printed fabrics, especially those with intense colours, may release pigments and cause a discolouration (fading) effect on the fabric of the Figuratti Furniture. These changes are natural characteristics of the wear and tear of the Product and are excluded from the scope of the Guarantee. 

Wrinkling on the upholstery surface of Figuratti Furniture

Wrinkles may occur on the upholstery surface of some Figuratti Furniture, especially those with loose fixing of the upholstery fabric (e.g. mattress, seat, cushion furniture), which can be smoothed out by hand.

Shimmering of velour fabrics and artificial leather

Some velour fabrics and artificial leather used in the manufacture of Figuratti Furniture may shimmer in the light. This is a characteristic of these fabrics and any claims related to this are excluded from the scope of the Guarantee.

The Manufacturer’s logo

Where the Manufacturer’s corporate logo is factory applied on a given Product, the Guarantee shall not apply to Products from which the Manufacturer’s corporate logo has been removed by the purchaser or the Product  user. 

Legal Remedies 

In the event of non-compliance of the Product with the agreement for the sale of the Product, the purchaser of the Product shall be entitled by law to legal remedies on the part and at the expense of the Manufacturer. The Guarantee shall not affect such legal remedies. Specifically, the Guarantee does not exclude, limit or suspend the rights of the Product purchaser under the warranty for defects in the Product.

II. Guarantee Procedure

The person authorised under the Guarantee should comply with this guarantee procedure in order to benefit from the Guarantee.

The person authorised under the Guarantee 

The proof of purchase of the Product is the Invoice issued by the Manufacturer. The original Invoice signed by the Manufacturer or the Invoice in the electronic version generated automatically upon the purchase of the Product together with the email in which the Invoice was sent should be kept for the entire Guarantee period. The Invoice shall be the basis for the Manufacturer’s consideration of any guarantee claims.

The person authorised under the Guarantee is the purchaser of the Product or any user of the Product who holds the original Invoice signed by the Manufacturer or the Invoice in the electronic version generated automatically upon the purchase of the Product together with the email in which the Invoice was sent (hereinafter the “Authorised Person”). 

Contacting the Manufacturer’s guarantee service

Should it be necessary to report a problem covered by the Guarantee (“Guarantee Notification“), the Authorised Person should contact Figuratti’s customer service department at telephone number +48 606 476 239 or by sending an email to guarantee@figuratti.pl.

Invoice as a basis for the processing of claims

In order to submit the Guarantee Notification, the Manufacturer must be presented with the original Invoice signed by the Manufacturer or with the electronic Invoice automatically generated upon purchase of the Product together with the email in which the Invoice was sent.

The Invoice shall be the basis for the Manufacturer’s consideration of the Guarantee Notification

Failure to submit the Invoice in the aforementioned form excludes the possibility of benefiting from the Guarantee

Acceptance of the Guarantee Notification

Where there are reasonable grounds for recognising liability under the Guarantee, the Manufacturer shall proceed accordingly. 

Repair or replacement

If the Manufacturer acknowledges the validity of the Guarantee Application, the Manufacturer shall take appropriate action to repair the Product or replace it with another Product. The Authorised Person shall be obliged to provide the Manufacturer with the Product covered by the Guarantee Notification. The Manufacturer shall not be obliged to provide the Authorised Person with a replacement Product for the duration of the Guarantee Notification processing.

Place of repair or replacement 

If the Manufacturer acknowledges the validity of the Guarantee Notification, the Product must be delivered to the Manufacturer’s registered office, i.e. to the Manufacturer’s factory in Warsaw at 6 Suflerska Street, 04-471 Warsaw.

Term for processing the Guarantee Notification

The Manufacturer shall handle each Guarantee Notification individually.

The Manufacturer shall perform all guarantee activities immediately, however, due to the different scope of the Guarantee Notification, the term of consideration and processing of the Guarantee Notification shall be each time determined individually by the Manufacturer based on the specifics of the given Guarantee Notification and its individual parameters. In the event that the Manufacturer accepts the validity of the Guarantee Notification, the term for repair or replacement of the Product shall depend on the specifics of the guarantee measures and individual parameters of such measures. 

The Manufacturer shall inform the Authorised Person about the term of consideration and procedure of the Guarantee Notification within 7 working days from the receipt of the Guarantee Notification.

Waiver of  Guarantee Rights 

If the Authorised Person prevents the repair from being performed, the Authorised Person shall be deemed to have waived his/her guarantee rights.

III. Manufacturer’s Key Recommendations For The Purchaser Or User Of The Figuratti Furniture

The purchaser or user of the Product shall be responsible for its proper use. 

Damage to the Product and excessive wear and tear can result from a number of factors. In this section of the Guarantee Card, the Manufacturer provides the key recommendations for the use of Figuratti Furniture

The following list of recommendations is not exhaustive. It refers to the recommendations that the purchaser or any user of the Figuratti Beds should observe. The Manufacturer shall not be liable for any damage or signs of wear and tear to the Product resulting from the failure of the purchaser or user of the Product to observe the following recommendations. 

In the event of specific queries regarding the use of the Product, Figuratti recommends each purchaser or user of the Product to contact the Manufacturer individually. 

Protection against mechanical damage

The purchaser or any user of the Product shall be obliged to protect the Product against unreasonable mechanical damage which may be caused, for example, by sitting on the headrest board, footrest or backrest edges.

Unfolding the Figuratti Furniture

  • When unfolding the Product being a bed from a lying to a sitting position, always do so while standing behind the bed.
  • To lower the headrest, push it all the way down. Once lowered, there should be a sound from the mechanism, indicating that the headrest is in the zero position.
  • The headrest or footrest should always be raised or lowered with no person lying down to avoid damaging the mechanism.

Cleaning of the upholstery fabrics of the Figuratti Furniture.

The purchaser or any user of the Product shall observe the cleaning recommendations for the Figuratti Furniture

The main recommendations for cleaning the Figuratti Furniture are specified below: 

  • The upholstery fabrics of the Figuratti Furniture cannot be cleaned with chemicals such as solvent, thinner, petrol or alcohol.
  •  Eco-leather fabrics can be cleaned with a soft cloth using a solution of water and grey soap and then wiped dry. Eco-leather care products can also be used for cleaning.
  •  General fabric care includes cleaning the outer surface of the Figuratti Furniture upholstery with a soft clothes brush or a hoover with an upholstery brush attachment.
  •  Avoid heavy pressure when cleaning to prevent colour bleaching.
  •  For the leather of the Figuratti Furniture, use only products designed for cleaning leather furniture.

Permissible load for bent-glued chairs  

The maximum permissible load for the Figuratti Furniture of the Loft series is 200 kg. The maximum permissible load for the Figuratti Furniture of the Elevate series on a hydraulic lift is 150 kg.

Zips 

The zips on the covers of Figuratti Furniture are used for technological purposes only and are not used to open or remove the covers. Opening these zips may lead to damage to the Product. The Manufacturer shall not be liable for damage caused by attempting to open the zips.

Glueing the Product components

In order to avoid scratches by Product components that are in direct contact with the floor, it is recommended to glue these components with felt pads.

Avoiding contact with heat sources

Figuratti Furniture should not be placed less than half a metre from active heat sources such as radiators, ovens, kettles, irons, etc.

Protection of the Product from Sunlight and Moisture

Figuratti Furniture must not be directly exposed to sunlight or exposed to high humidity (above 80%).
